By accessing or using Sip2Sip.my, placing an order or purchasing products from us, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our website or place an order.

2. ABOUT OUR PRODUCTS AND SERVICES

Sip2Sip.my offers wines, spirits and other related products for sale in Malaysia.

We aim to provide accurate product descriptions, photographs, tasting notes, prices, availability and other product information. However, product images, labels, packaging, vintages and other details may vary from the information displayed on our website.

Unless otherwise stated, products are subject to availability.

We reserve the right to limit quantities, discontinue products or change product availability at any time.

3. AGE REQUIREMENT FOR ALCOHOLIC BEVERAGES

Sip2Sip.my sells alcoholic beverages. You must be at least 21 years old to purchase alcoholic beverages through our website.

By placing an order for alcoholic beverages, you confirm that you are at least 21 years old and legally permitted to purchase and consume alcoholic beverages under applicable Malaysian law.

We may request proof of age or identity before accepting an order or completing delivery.

We reserve the right to refuse or cancel an order if we reasonably believe that the customer does not meet the applicable age requirement or is unable to provide satisfactory age verification.

We may also refuse delivery where the recipient appears to be underage or is unable to provide satisfactory proof of age or identity when requested.

4. PRODUCT INFORMATION

We make reasonable efforts to ensure that product information displayed on Sip2Sip.my is accurate and up to date.

However, errors may occasionally occur, including errors relating to product descriptions, prices, availability, vintage, photographs or other information.

We reserve the right to correct errors, update information or cancel affected orders where necessary.

Wine is an agricultural product and may naturally vary between vintages, bottles and production lots. Differences in taste, aroma, colour or other characteristics do not necessarily indicate that a product is defective.

5. PRICES

All prices displayed on Sip2Sip.my are in Malaysian Ringgit (RM), unless otherwise stated.

Prices may change from time to time. However, where an order has been accepted by us, we will generally honour the price confirmed for that order, except where the order is affected by an obvious pricing error, fraud or other circumstances that reasonably require cancellation or correction.

Unless otherwise stated, delivery charges and other applicable fees will be displayed during the checkout process or communicated to you before order completion.

6. PROMOTIONS, DISCOUNTS AND VOUCHERS

Promotions, discounts, vouchers, campaign offers and other special offers may be subject to additional terms and conditions.

Unless expressly stated otherwise:

  • Promotions cannot be exchanged for cash.
  • Promotions cannot be combined with other promotions or discounts.
  • Promotional products are subject to availability.
  • Discounts or vouchers may be subject to minimum purchase requirements.
  • We reserve the right to amend or withdraw a promotion where reasonably necessary.

Any specific promotional terms displayed on Sip2Sip.my will take precedence over these general promotional conditions where there is a conflict.

7. PLACING AN ORDER

When you place an order through Sip2Sip.my, you are making an offer to purchase the selected products at the stated price, subject to these Terms.

After placing an order, you may receive an order confirmation or acknowledgement. This does not necessarily mean that your order has been accepted.

An order will be considered accepted when we confirm acceptance of the order or begin processing the order, unless we notify you otherwise.

We reserve the right to refuse or cancel an order for reasonable reasons, including:

  • The product is unavailable.
  • There is an obvious pricing or product information error.
  • Payment cannot be successfully processed.
  • We are unable to verify the required information.
  • The order appears fraudulent or suspicious.
  • The customer does not meet the applicable age requirement.
  • Delivery to the specified location cannot reasonably be completed.
  • Other circumstances prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will arrange an appropriate refund for the amount paid for the cancelled order, subject to applicable law.

8. PAYMENT

Payment must be made using the payment methods available on Sip2Sip.my at the time of purchase.

Orders will generally only be processed after successful payment confirmation, unless otherwise agreed by us.

If your payment is unsuccessful, reversed, declined or otherwise not received, we may suspend or cancel the relevant order.

You are responsible for providing accurate payment and billing information.

9. DELIVERY

We deliver to locations within Malaysia where delivery service is available.

Delivery charges, available delivery areas and estimated delivery times may vary depending on the delivery address, order size, product availability and delivery service selected.

Any delivery time shown on our website is an estimate only and is not guaranteed unless expressly stated otherwise.

Delivery may be delayed due to circumstances beyond our reasonable control, including courier delays, severe weather, public holidays, traffic conditions, operational disruptions or other unforeseen events.

We will make reasonable efforts to arrange delivery within the estimated timeframe communicated to you.

10. DELIVERY OF ALCOHOLIC BEVERAGES

For orders containing alcoholic beverages, delivery may be subject to age verification.

The recipient may be required to provide proof of age or identity before the alcoholic beverages are handed over.

We reserve the right to refuse delivery where:

  • The recipient is under 21 years old.
  • The recipient cannot provide satisfactory proof of age or identity when requested.
  • The recipient appears to be intoxicated or otherwise unable to safely receive the order.
  • There are reasonable grounds to believe that the delivery would breach applicable law or our policies.

Where delivery is refused for reasons relating to age verification, identity verification or legal requirements, additional delivery charges or other costs may apply where permitted by law.

11. DELIVERY ADDRESS AND FAILED DELIVERY

You are responsible for providing a complete and accurate delivery address and contact information.

We are not responsible for delays, failed deliveries or additional delivery costs resulting from incorrect, incomplete or outdated information provided by you.

If a delivery cannot be completed because nobody is available to receive the order, the recipient cannot be contacted, or required age or identity verification cannot be completed, the courier may return the order to us.

Any additional delivery or redelivery charges may be payable by the customer where applicable.

12. RECEIVING YOUR ORDER

You should inspect your order as soon as reasonably possible after delivery.

If you receive an incorrect, missing or visibly damaged product, please contact us as soon as possible and preferably within 48 hours of delivery.

Where appropriate, please provide photographs of the packaging, shipping carton and affected product to assist us in investigating the issue.

13. DAMAGED, INCORRECT OR DEFECTIVE PRODUCTS

If your order arrives damaged, contains the wrong product, or a product is missing, please contact us as soon as possible.

Depending on the circumstances, we may offer a replacement, refund, credit or other appropriate remedy.

We may request photographs, order details, delivery information or other reasonable evidence before determining the appropriate resolution.

If a product is genuinely defective or has a wine fault, please contact us before disposing of the product where reasonably possible. We may require the affected bottle or remaining contents to be retained for assessment or verification.

Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable Malaysian law.

14. WINE QUALITY AND TASTE

Wine is a natural product and individual taste preferences vary.

A customer not enjoying the taste, aroma, style, sweetness, acidity, tannin, body or other characteristics of a wine does not by itself mean that the product is defective.

Product descriptions, tasting notes and food pairing suggestions are provided for general information and are not guarantees of personal taste or preference.

If you believe that a wine has a genuine quality issue or wine fault, please contact us so that we can assess the matter.

15. RETURNS, REFUNDS AND CANCELLATIONS

Because alcoholic beverages are subject to age, storage and handling considerations, returns are not automatically accepted simply because a customer changes their mind or does not enjoy the taste of a product.

However, this does not affect any rights or remedies available to you under applicable Malaysian law.

If you wish to cancel an order, please contact us as soon as possible. We will try to accommodate cancellation requests before the order has been processed or dispatched, but cancellation may not be possible once the order has been fulfilled or handed over for delivery.

Where a refund is approved, the refund method and processing time may depend on the original payment method and relevant payment provider.

16. CUSTOMER ACCOUNTS

If you create an account on Sip2Sip.my, you are responsible for keeping your login information confidential and for activities carried out through your account.

You should notify us promptly if you believe that your account has been accessed without your authorisation.

We reserve the right to suspend or terminate an account where reasonably necessary, including where there is suspected fraud, misuse, unlawful activity or violation of these Terms.

17. GIFT ORDERS

If you place an order for delivery to another person, you are responsible for ensuring that the delivery information provided is accurate.

The recipient of an alcoholic beverage order must still satisfy all applicable age and identity verification requirements at the time of delivery.

Being the intended recipient of a gift does not remove or reduce the applicable age requirement.

18. REVIEWS, COMMENTS AND USER CONTENT

If you submit a review, comment, photograph, feedback or other content to Sip2Sip.my, you agree that the content should not:

  • Be unlawful, misleading, fraudulent or defamatory.
  • Infringe the intellectual property or other rights of another person.
  • Contain malicious software or harmful code.
  • Contain inappropriate, offensive or abusive material.
  • Impersonate another person or misrepresent your affiliation with another person or organisation.

By submitting content to us, you grant us a non-exclusive, royalty-free right to use, reproduce, publish and display that content for purposes related to our business, website, marketing and communications, subject to applicable law.

We reserve the right to remove or refuse to publish content that we reasonably consider inappropriate, unlawful or inconsistent with these Terms.

We are not responsible for the availability, content, accuracy, security or practices of third-party websites or services that we do not control.

21. WEBSITE AVAILABILITY AND ERRORS

We aim to keep Sip2Sip.my available and functioning properly, but we do not guarantee that the website will always be available, uninterrupted, secure or error-free.

The website may occasionally be unavailable due to maintenance, technical problems, security incidents, third-party service interruptions or other circumstances.

We reserve the right to modify, suspend or discontinue any part of the website or its services where reasonably necessary.

22. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, RS Wines & Spirits Sdn Bhd will not be liable for indirect, incidental, special or consequential loss arising from your use of Sip2Sip.my or your purchase of products, except where such liability cannot lawfully be excluded.

Nothing in these Terms excludes, restricts or limits any liability, right or remedy that cannot legally be excluded or limited under applicable Malaysian law.

Where we are legally responsible for a loss or damage, our liability will be limited to the extent permitted by applicable law and, where appropriate, to the amount reasonably attributable to the relevant product, order or service giving rise to the claim.

23. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for delay or failure to perform our obligations where the delay or failure results from circumstances beyond our reasonable control.

Such circumstances may include natural disasters, severe weather, fire, flood, epidemic or pandemic restrictions, government action, changes in law, strikes, labour disputes, transportation disruption, courier failures, telecommunications failures, power outages, cyber incidents or other unforeseen events.

Where reasonably possible, we will notify affected customers and take reasonable steps to minimise the impact of such circumstances.

24. INDEMNIFICATION

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities or reasonable costs arising from your unlawful use of Sip2Sip.my, your violation of these Terms, or your infringement of the rights of another person.

This section does not apply to the extent that the relevant loss or liability results from our own negligence, unlawful conduct or other circumstances for which liability cannot legally be excluded.

Your continued use of Sip2Sip.my after the updated Terms are published constitutes acceptance of the updated Terms for future use of the website and future orders.

Changes will not retrospectively alter an order that has already been accepted, except where required by law or where otherwise agreed with you.

27. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be modified or removed to the minimum extent necessary, while the remaining provisions will continue to apply.

Any dispute arising from or relating to these Terms or your use of Sip2Sip.my shall be subject to the applicable courts of Malaysia, subject to any mandatory rights or remedies available to you under applicable law.
